Remit:

To consider and report on matters relating to transport, infrastructure and climate change falling within the remit of the Cabinet Secretary for Finance and Sustainable Growth.

Subordinate Legislation

The Committee reports to the Parliament as follows—

1. At its meeting on 10 June 2008, the Transport, Infrastructure and Climate Change Committee took evidence on the Public Transport Users’ Committee for Scotland Amendment Order 2008 (SSI 2008/186) and the Mobility and Access Committee for Scotland Revocation Regulations 2008 (SSI 2008/187) from—

Stewart Stevenson MSP, Minister for Transport, Infrastructure and Climate Change;

Bill Brash, Senior Policy Officer, Diane McLafferty, Head of Transport Strategy, Transport Directorate and Jacqueline Pantony, Principal Legal Officer, Scottish Government.

2. Cathy Peattie MSP raised a number of issues of concern about both negative instruments. Members expressed concern at the lateness of the provision by the Scottish Government of the equality impact assessment related to these instruments. This was only received on the morning of the Committee meeting and was considered important to the Committee’s consideration of the instruments. The Minister responded to Members’ concerns, restating many of the points set out in a letter from the Cabinet Secretary for Finance and Sustainable Growth, John Swinney MSP, to the Convener of the Equal Opportunities Committee1

3. Following the evidence session, Cathy Peattie MSP moved S3M-2022—

That the Transport, Infrastructure and Climate Change Committee    recommends that nothing further be done under the Public Transport Users’ Committee for Scotland Amendment Order 2008 (SSI 2008/186).

4. After debate, the motion was agreed to (by division: For 5, Against 3, Abstentions, 0).

5. Cathy Peattie MSP then moved S3M-2023—

That the Transport, Infrastructure and Climate Change Committee    recommends that nothing further be done under the Mobility and Access Committee for Scotland Revocation Regulations 2008 (SSI 2008/187).

6. After debate, the motion was agreed to (by division: For 5, Against 3, Abstentions 0).

7. The Committee further agreed to report the outcome of its considerations to the Parliament.
