Remit:

To consider and report on (a) the administration of criminal and civil justice, community safety, and other matters falling within the responsibility of the Cabinet Secretary for Justice and (b) the functions of the Lord Advocate, other than as head of the systems of criminal prosecution and investigation of deaths in Scotland.

Report on Subordinate Legislation

The Committee reports to the Parliament as follows—

1. At its meeting on 25 June 2008 the Justice Committee took evidence on the Court of Session etc. Fees Amendment Order 2008 (SSI 2008/236); the High Court of Justiciary Fees Amendment Order 2008 (SSI 2008/237); the Adults with Incapacity (Public Guardian's Fees) (Scotland) Amendment Regulations 2008 (SSI 2008/238); and the Sheriff Court Fees Amendment Order 2008 (SSI 2008/239) from—

Fergus Ewing MSP, Minister for Community Safety, Scottish Government;

Eleanor Emberson, Chief Executive, Gordon Wales, Director of Operational Support, and Nicola Bennett, Director of Finance, Scottish Court Service.

2. Bill Butler moved—

S3M-2212: That the Justice Committee recommends that nothing further be done under the Court of Session etc. Fees Amendment Order 2008 (SSI 2008/236).

S3M-2214: That the Justice Committee recommends that nothing further be done under the Adults with Incapacity (Public Guardian’s Fees) (Scotland) Amendment Regulations 2008 (SSI 2008/238).
