Finance Committee - Scrutiny of Financial Memoranda

Introduction

The Committee considers the financial implications of legislation through scrutiny of Financial Memoranda (FMs), which are produced to accompany a bill's introduction.  For further information on the legislative process, please see the Bills section of the website (click link).  The Committee has agreed to adopt three levels of scrutiny in relation to FMs which are detailed below.

  • Level 1 - the Committee seeks written evidence from organisations financially affected using a standard questionnaire and any responses received are passed directly to the lead committee considering the bill. This is completed in advance of the lead committee’s evidence session with the relevant minister at Stage 1.
  • Level 2 - the Committee seeks written evidence from affected organisations before taking oral evidence from the Executive bill team and then producing a report. Again this is issued to the lead committee in advance of evidence from the relevant minister.
  • Level 3 - the Committee seeks written evidence from affected organisations, takes oral evidence from affected organisations followed by evidence from the Executive bill team and then produces its report.

The Disabled Persons' Parking Places (Scotland) Bill

The Bill was introduced in the Parliament on 2 June 2008.  At its meeting on 10 June 2008, the Committee agreed to adopt level 2 scrutiny in relation to the Bill. 

The Committee received submissions from Glasgow City Council, Fife Council, the Scottish Government and ACPOS and took evidence from Jackie Baillie MSP at its meeting on 16 September 2008.  Please follow the link below to the committee papers (including submissions) and the Official Report of the session.

Sexual Offences (Scotland) Bill

The Bill was introduced in the Parliament on 17 June 2008.  At its meeting on 24 June, the Committee agreed to adopt level 1 scrutiny in relation to the Bill.  Submissions were received from ACPOS, COPFS, the Scottish Court Service and the Scottish Children's Reporters Administration and then forwarded to the lead committee on the Bill.  Please follow the link below for the submissions.


Damages (Asbestos-Related Conditions) (Scotland) Bill

The Bill was introduced in the Parliament on 23 June 2008.  At its meeting on 24 June, the Committee agreed to adopt level 1 scrutiny in relation to the Bill.  The Committee received four submissions, from the Scottish Court Service, the Association of British Insurers, Zurich Financial Services and AXA Insurance UK plc.

Health Boards (Membership and Elections) (Scotland) Bill

The Bill was introduced in the Parliament on 25 June 2008.  At its meeting on 16 September, the Committee agreed to adopt level 2 scrutiny in relation to the Bill, but at its meeting on 28 October, the Committee agreed to re-classify the FM as level 3, in light of the written evidence received.

The Committee received correspondence from the Cabinet Secretary for Health and Wellbeing on 12 September, which updates some of the information contained in the Financial Memorandum.  Please follow the link below for the correspondence.

At its meeting on 4 November 2008, the Committee took evidence from the Electoral Registration Committee of the Scottish Assessors’ Association and Scottish Government officials.  Please follow the links below for the committee papers (including all submissions received) and the Official Report of the session.


Offences (Aggravation by Prejudice) (Scotland) Bill

The Bill was introduced in the Parliament on 19 May 2008.  At its meeting on 30 September, the Committee agreed to adopt level 1 scrutiny in relation to the Bill.  All submissions received will be available here in due course.


Scottish Parliamentary Pensions Bill

The Bill was introduced in the Parliament on 22 September 2008.  At its meeting on 30 September, the Committee agreed to adopt level 2 scrutiny in relation to the Bill.  The Committee took oral evidence from Alasdair Morgan MSP, the Member in Charge of the Bill, at its meeting on 7 October 2008, and received a written submission from the SPCB.  Please follow the link below to the meeting papers (including the submission) and official report of the session.

Flood Risk Management (Scotland) Bill

The Bill was introduced in the Parliament on 29 September 2008.  At its meeting on 7 October, the Committee agreed to adopt level 3 scrutiny in relation to the Bill.

The Committee will take evidence from affected organisations at its meeting on 18 November 2008 and from Scottish Government officials at its meeting on 25 November 2008.  Please follow the links below to the committee papers for 18 November (including all submissions received).


Education (Additional Support for Learning) (Scotland) Bill

The Bill was introduced in the Parliament on 6 October 2008.  At its meeting on 28 October, the Committee agreed to adopt level 1 scrutiny in relation to the Bill.  All submissions received will be available here in due course.
