New amendments to Bills lodged on 12 December 2001 Scottish Local Government (Elections) Bill Stage 3 Section 4 Peter Peacock 1 In section 4, page 4, line 3, after <Acts> insert <(a)> Peter Peacock 2 In section 4, page 4, line 8, at end insert <; or (b) for any other matter which relates to action to be taken, or procedure to be carried out, before or during the poll which is to be held at the election. ( ) A scheme may make provision such as is mentioned in paragraph (b) of subsection (2) above only where, in the opinion of the local authority which proposed the scheme, that provision is likely to (a) facilitate voting by any persons or any class of persons; or
New amendments to Bills lodged on 13 December 2001 Protection of Wild Mammals (Scotland) Bill Stage 3 After section 6 Mr Mike Rumbles 1 After section 6, insert <Compensation for affected individuals and businesses (1) There shall be a Commission on Hunting Compensation. (2) The Scottish Ministers may by order made by statutory instrument make such further provision about the Commission as they consider appropriate, including provision about the appointment of the members and staff of the Commission. (3) The functions of the Commission shall be (a) to establish a scheme for compensation in respect of loss of earnings, pension rights and tied accommodation (or losses of any other kind) incurred by persons whose businesses or employment are directly affected by the enactment or coming into force of this Act; (b) to determine a claimants entitlement to compensation under the scheme and the amount of any such compensation; (c) to pay such amounts of compensation as are determined under paragraph (b). (4) A scheme established under subsection (3)(a) above must, in particular (a) specify the losses in respect of which payments are to be made; (b) specify the classes of person or types of business or employment in respect of which payments are to be made; (c) specify the basis of valuation for determining losses; (d) specify the amounts of payments to be made or the basis on which such amounts are to be calculated; (e) provide for the procedure to be followed (including the time within which claims must be made and matters relating to the provision of information) in respect of claims under the scheme and for the determination of such claims, and may make different provision for different cases or descriptions of case. (5) Before making any such scheme, the Commission must consult (a) such persons as may be entitled to payment under the scheme, and (b) such organisations as appear to them to represent such persons, as they think fit. (6) No order is to be made under subsection (2) unless a draft has been laid before, and approved by resolution of, the Scottish Parliament. (7) The Scottish Ministers shall, from time to time, make such payments to the Commission as they consider necessary to allow the Commission to carry out its functions.>
